This is a privacy notice for Viv Chitty Associates. In this document ‘we’, ‘our’ and ‘us’ refers to Viv Chitty and named associates. We will describe how we collect, store, and use your personal information as well as the rights you have in relation to your personal information.

We use cookies on our website in order to personalise our service to you. Cookies are used: track how users navigate through the website; evaluate and improve the website by deriving information to enable statistical analysis of how the website is being used and ascertain whether the website is operating effectively.

Coaching and supervision clients

We will collect information about you because you have agreed to be coached or supervised by us. For Viv Chitty and her coaching associates to provide the service of executive coaching and coach supervision it is necessary that we gain and process data from the coaching or supervision client. By undertaking coaching or supervision you are consenting to Viv Chitty Associates storing and using the personal information you have provided us with as set out by this notice. If you do not want your personal information to be used or held then please do not provide this to us or exercise your rights to have your data deleted.

Data to be obtained and held
Data will be obtained from you at the start of the coaching contract and during sessions. As part of this contracted coaching relationship you give the coach consent to hold your data in the form of:

  • your full name
  • job title
  • company you are currently working for
  • email address or addresses
  • preferred contact numbers
  • CV (if applicable)
  • previous psychometric test reports (if applicable)
  • handwritten notes detailing what you have said, taken in sessions, and related paper documentation such as Coaching Development Plans.

How we use your data
Viv Chitty and her associates are committed to respecting your privacy and personal information and will only use the information you have given us for the performance of a contract with you for the delivery of coaching or supervision. Handwritten notes are taken for the purpose of record keeping for the coach.

Where applicable we will use your non-sensitive personal data to i) collect and recover monies owed to us and ii) to manage our relationship with you.

The data shall not be further processed in any manner incompatible with that purpose or those purposes.

We will not share your details with third parties for marketing purposes.

Client Confidentiality
We treat the information you provide us with as confidential.
The contents of these coaching sessions, together with any impressions obtained during such sessions and any notes made by the coach, will be confidential between the coach and the client and the coach will be under no obligation to disclose any information arising from these sessions to the employing organization. The coach will only talk about coaching process to the line manager/HR representative.

Disclosure of your personal data
Notwithstanding the above, in the event that, in the reasonable opinion of the coach, a coaching client/employee is at risk of causing harm to themselves or others parties or if there is involvement in illegal activity, it is agreed that the coach may disclose this information to the employer/client and/or any other appropriate body.

In addition, we will discuss our work with you (using your first name only) with our coaching supervisors as part of on-going professional supervision to ensure best practice. This is a confidential environment and we require the supervisors to whom we transfer any relevant data to respect the security of your personal data and to treat it in accordance with the law and their professional code of conduct.

Protection of your information
Viv Chitty Associates protects your information. Appropriate technical and organisational measures have been taken to prevent your data being accidentally lost, used or accessed in an unauthorized way, altered or disclosed. Associate coaches will only process your personal data on Viv Chitty’s instructions and are subject to a duty of confidentiality.

We request that you create your Coaching Development Plan using the template supplied by your employing organization and that you share this document in a way that is password protected. This ensures that you are fully in control of the document and able to edit or rescind access rights.

We may anonymize your personal data (so you can no longer be identified from such data) for research or statistical purposes in which case we may use this information indefinitely without further notice to you.

Data retention
We will only keep your personal data for as long as is necessary to fulfil the purposes for which we collected it. We many retain your data to satisfy any legal, accounting or reporting requirements so for example, we need to keep certain information about you for six years after you cease to be a client for tax purposes.

Keeping your data up-to-date
We have a duty to keep your personal data up to date and accurate, so from time to time we will contact you to ask you to confirm that your personal data is still accurate and up to date.

If there are any changes to your personal data (such as a change of address) please let us know as soon as possible by writing or emailing Viv Chitty.

Your rights:

Right to erasure (Right to be forgotten)

If you have already consented to Viv Chitty Associates using and holding your personal information, you are within your rights to:

  • withdraw consent, clearly describing which element of the data you are asking to be addressed;
  • ask Viv Chitty Associates to stop holding your contact information or your session notes at any time;
  • request that all data is erased at any point.

Right of access
You can ask for a copy of your personal data and an explanation of how it is being used.
If you would like to do so, in the first instance please ask your coach for a data Subject Access Request.
We will not charge a fee for responding to this request unless your request if clearly unfounded, repetitive or excessive. In which case we may charge a reasonable fee or decline to respond.
We will, in most cases, reply within one month of the date of the request unless your request is complex or you have made a large number of requests in which case we will notify you of any delay and will in any event reply within three months.

Right to rectification
You have the right to view the data held and to correct, revise or remove any personal data which has been retained at any point.

Right to restrict processing
If you believe, for example, that your personal data is inaccurate or collected unlawfully, you may request limited use/processing of your personal data.

Right of portability:
Individuals have the right to receive their personal data in a structured, commonly used and machine-readable format.

Right to complain

  • You have the right to complain about how your data is being used. We are committed to protecting your personal data but if for some reason you are not happy with any aspect of how we collect and use your data, you have the right to complain to the Information Commissioner’s Office (ICO), the UK supervisory authority for data protection issues (www.ico.org.uk). We should be grateful if you would contact us first if you do have a complaint so that we can try to resolve it for you.
